GOVERNMENT OF SINDH,
EDUCATION & LITERACY DEPARTMENT,
Karachi dated 16th February, 2009.
Phone # 021-9213482
To:
The Secretary to Govt. of Sindh,
Law Department,
Karachi.
Subject: Islamia College Complex.
I am directed to refer to the above and state that the matter of Islamia Colleges/Schools is under litigation at different courts. The Education and Literacy Department in consultation with Law Department is vigorously contending the cases at all available legal forums.
Briefly, Islamia College Complex managed by Islamic Education Trust was nationalized in the year 1972 under MLR-118. Presently, four colleges and the same number of schools are located in the premises of complex.
Dec 21, 10, 01:53 PM Letter Part Two:
Well over 17,000 students are under education in all the institutions both in morning and evening shifts. Of these, two groups are striving to get the possession of complex and utilize the same for their personal gains. The third one Mr. Kamran Hussain, the grandson of Late Mr. Qureshi, who was the founder of Islamic Education Trust is also claiming to be the real owner of the trust. Meetings were held Mr. Kamran Hussain, who seems keenly interested and is of the view that the Complex must remain under the control of Govt. of Sindh for the purpose of imparting education, which was the ambition of his late grandfather. According to Mr. Kamran, the other groups are greedy, who are bent upon to acquire the title of the college complex use it for other purposes, copy of letter No. SO (COORD-I) / SGA&CD / PDS-638 / 08 dated 16 January 2009 along with its enclosures is enclosed.
Dec 21, 10, 01:51 PM Letter Part Three:
Mr. Kamran has further suggested that they have no objection, if the Government acquires the said land. Therefore, the law Department is requested to favour this department with its considered opinion that under what provisions of law, the government can acquire the same. Mr. Kamran further stated that the erstwhile K.M.C. under Resolution No. 1255 had allotted the land under agreement dated 27.5.1958. The clause No. 2 and 4 of agreement have been violated by trustees, therefore, the City District Government, Karachi can revoke the said agreement and the said 99 years lease of the plot whereupon the college complex was built over.
Dec 21, 10, 01:51 PM Letter Part Four:
Besides this it is a matter of record that the said property was granted by the Government as a "Pepper grant" a term used at Rs. 2/- per annum for education purposes.
An early advice is requested.
